Welcome to Wry Bird. The terms "we", "us" and "our" refer to Wry Bird, a sole trader based in Scotland. Wry Bird operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Wry Bird is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as our products, orders, returns, intellectual property and limitations of liability.

Colours may appear differently on different screens depending on the device, display and settings used.
Because our products are produced using print-on-demand manufacturing, there may be minor variations between individual products, including slight variations in colour, print positioning, measurements or appearance.
Such variations will not affect your statutory rights where a product is faulty, not as described or otherwise does not conform to applicable consumer law.
We reserve the right to update product descriptions, specifications, pricing and availability from time to time.
We may discontinue a product at any time, but this will not affect an order that we have already accepted unless required by law or agreed with you.
SECTION 3 - ORDERS
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing an order, you will receive an email confirming that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted.
Your order is accepted when we confirm acceptance or, where applicable, when we begin processing the order for fulfilment.
We reserve the right to decline or cancel an order where there is a legitimate reason to do so, including where:

there is an obvious error in the price or product information;

we are unable to fulfil the order;

we reasonably suspect fraudulent or unlawful activity; or

circumstances outside our reasonable control prevent fulfilment.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
Please review your order carefully before submitting it. Because our products are made to order, we may be unable to accommodate changes or cancellation requests once an order has entered production.

SECTION 4 - PRICES AND BILLING
All prices are displayed in [GBP / £], unless otherwise stated.
Prices include VAT where applicable. If VAT is not applicable to our business, prices will be displayed accordingly.
Delivery charges, where applicable, will be shown before you complete your purchase.
The price charged for a product will be the price displayed at the time you place your order, except where there is an obvious pricing error.
We may change prices, discounts and promotions from time to time. Any changes will not affect an order that we have already accepted.
If we discover an obvious error in the price of a product you have ordered, we will contact you as soon as reasonably possible. We may cancel the order and refund you where the price was clearly incorrect and could reasonably have been recognised as an error.
You agree to provide accurate and complete payment information for all purchases made through our store.
Payment must be successfully received before we can process your order.
SECTION 5 - SHIPPING AND DELIVERY
We will provide estimated delivery information on our website and/or during checkout.
Delivery times are estimates and may vary depending on the product, destination, fulfilment process and delivery carrier.
We will aim to dispatch and deliver your order within the timeframe stated at checkout or otherwise agreed with you.
We are not responsible for delays caused by circumstances outside our reasonable control, including severe weather, industrial action, carrier disruption, customs delays, or other unforeseen events.
However, nothing in these Terms limits any rights you have under applicable consumer law where goods are not delivered within the required timeframe or as agreed.
For consumer purchases, responsibility for the goods remains with us until the goods come into your physical possession, or the possession of a person you have identified to receive them, unless applicable law provides otherwise.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to our trademarks, brand, text, images, graphics, photographs, product designs, illustrations, product descriptions, logos, slogans, videos and other content, are owned by Wry Bird or are used under licence and are protected by applicable intellectual property laws.
Our designs and artwork are an important part of Wry Bird and may not be copied, reproduced, modified, distributed, sold, licensed or commercially exploited without our prior written permission.
Purchasing one of our products does not give you ownership of, or permission to reproduce, the artwork or design printed on that product.
You may use our website for your personal, non-commercial purposes.
You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, commercially exploit or otherwise use our website content or designs without our prior written permission.
All rights not expressly granted to you are reserved by Wry Bird.

These tools may be provided by third parties and we do not necessarily monitor or control them.

Wry Bird is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through our Store are made directly with Wry Bird.
Shopify is not the seller of our products and is not responsible for the fulfilment, quality, condition, returns or refunds relating to products purchased from Wry Bird.
Nothing in this section affects any rights you may have against Wry Bird or any rights that cannot legally be excluded.

By submitting Feedback to us, you grant Wry Bird a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that Feedback for the purposes of operating, improving and promoting our business.

If you use the Services in breach of these Terms and this causes Wry Bird to suffer a loss, damage, liability or reasonable expense, you may be responsible for that loss to the extent permitted by law.
This section does not apply to the extent that it would impose an unfair or unreasonable obligation on a consumer or conflict with applicable consumer law.

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be removed or modified to the minimum extent necessary.
The remaining provisions will continue to apply.

These Terms, together with our Refund & Returns Policy and Privacy Policy, form the agreement between you and Wry Bird concerning your use of our Services and your purchase of our products, subject to any additional terms provided at checkout or otherwise agreed with you.
If there is a conflict between these Terms and mandatory consumer law, the applicable consumer law will prevail.

You may not transfer your rights or obligations under these Terms to another person without our prior written consent, except where applicable law allows you to do so.

Any dispute arising from these Terms or your purchase from Wry Bird will be subject to the jurisdiction of the courts of Scotland, except where applicable consumer law gives you the right to bring proceedings in another court.
